1. About the Service

Hambone Sports is a daily sports trivia and guessing game operated by Kjenstad Digital ("Company", "We", "Us", or "Our"). The Service is provided for entertainment and educational purposes. Statistical data used in the Service is sourced from publicly available records and is provided without warranty of accuracy or completeness.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have obtained permission from a parent or legal guardian. By using the Service, you represent and warrant that you meet these requirements.

3. User Accounts

Creating an account is optional — you may play as a guest. If you create an account, you agree to:

You may not reproduce, distribute, modify, or create derivative works without our express written permission.

Statistical data (player names, career statistics, etc.) is factual information drawn from historical public records. We do not claim ownership of underlying facts, but our selection, arrangement, and presentation of that data is proprietary.

Hambone Sports is not affiliated with, endorsed by, or sponsored by Major League Baseball (MLB), the National Basketball Association (NBA), the National Football League (NFL), or any other sports league, team, or organization. All team names, league names, and logos referenced or depicted within the Service are the trademarks and property of their respective leagues, teams, ownership groups, and/or organizations. Their use here does not imply any affiliation or endorsement.

6. Third-Party Services

The Service may use or link to third-party services (e.g., Google OAuth for sign-in). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the content or practices of any third-party service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Statistical data may contain errors or omissions; it is presented for entertainment purposes only and should not be relied upon for research or commercial use.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KJENSTAD DIGITAL AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50).

9. Indemnification

You agree to indemnify, defend, and hold harmless Kjenstad Digital and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Idaho, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Idaho, and you consent to personal jurisdiction in those courts.

11. Changes to These Terms

We may revise these Terms at any time. When we do, we will update the "Last updated" date above. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
